Tips For Minimizing Your Chances Of Being Injured In Cruise Ship Accidents

miami tour

The summer vacation season of 2009 is wrapping up, but there are those out there who are still waiting to sail off into the sunset with a loved one on a cruise vacation. With the recent downturn in the economy, the cruise industry has recently been offering great rates to passengers. Because of this, many people have postponed their summer vacation to take advantage of these relaxing, fun-filled vacations. But, did you know that cruises can be a source of accidents and injuries which can put a big crimp in that dream vacation? After all, more than four million people cruise annually during a good economy, and that means cruise ship accidents can occur more often than you might think. These accidents don’t even have to happen on the high seas – many people are unaware that accidents involving shore excursions are also considered cruise ship accidents if the excursion is sponsored by the cruise line you are sailing with.

There are ways to minimize your potential for being injured in cruise ship accidents:

Verify that any onshore excursion you are going to participate in has insurance which will cover you or your family if an accident occurs. Check with your cruise line for safety information on the onshore excursion vendor; you may be surprised to learn that your cruise ticket restricts you from making a claim against the cruise line company for an injury which occurs during an onshore excursion. Be aware of where you are and what you are doing. CruiseShipJunkie.com reports the latest in cruise ship accidents. One story they have posted tells of a passenger who drank more than his share of alcohol and decided to go swimming in the ship’s pool. The problem with this idea was that the pool had been drained for repairs, so the inebriated passenger ended up diving headfirst into an empty pool. The moral of the story is: don’t overindulge even on vacation! Follow all posted warnings on board the ship. You will be walking on a moving ship that is sailing on the high seas. There is a chance that water will be in your path at some point, so it is a good idea to wear rubber-soled shoes that can give you traction on a wet deck surface. Use handrails to help you with your balance when the ship is under sail. You never know when the ship may list to one side or hit a rough patch of sea. If you use the on board sports facility, only use the equipment for its intended purpose. The same thing goes for deck chairs, sporting equipment, etc. Follow crew directions and instructions in the event of a power outage, fire, engine problem, or other emergency situation. Secure your belongings in the cabin’s closets or drawers so you aren’t hit by flying or falling objects if the ship encounters rough seas. While on shore excursions, listen to the directions of the tour operators, and follow their instructions. Be honest about physical abilities required for some shore excursions (or the lack thereof) that might cause you harm if you try to do something you are not capable of doing. For instance, if you last rode a horse twenty-five years ago, don’t be daring and ask for a spirited horse for your ride down the beach! Wear seat belts and proper restraints while on a tour and be sure your children do the same.

Hopefully, you will never have to worry about injury resulting from cruise ship accidents. However, if you are injured while on a cruise, you need to know that cruise ships operate under different laws than the rest of the vacation and tourism industry. “Depending on when and where your accident occurs, your claim may be controlled by Florida law, Federal Maritime law, or a law from a foreign port, says Florida cruise ship accident lawyer, Joseph M. Maus. “Accidents and injuries which occur on Cruise Ships can be won and lost on requirements which apply only to Cruise Ships. Take a look at your Cruise Ticket for some of these “special” requirements”.

Passenger tickets often have special provisions put into the fine print within the ticket which shortens the time in which a cruise ship passenger may file a law suit against the cruise line – usually this limit is one year. To give you an idea of how this differs from “regular” law, Maus says that the normal statute of limitations for admiralty and maritime matters is three years; for a typical car accident claim it is four years! These same provisions generally require you to give notice of a claim for injury or death due to negligence against the cruise line within six months. Cruise lines also designate within their passenger tickets the only location where they can be sued. Read through your ticket and you should find this suit location. Since most of the major cruise lines are based in Miami, Florida and will designate Miami, Florida as the location where they must be sued, this means that if you live in Wisconsin and sail on a cruise vacation, you may have to bring suit for an injury in Miami (we might add that this will be at considerable cost and time to you).

Enjoy your cruise vacation and see all those wonderful sights that a cruise ship can take you to. Take some time to relax on the ship and unwind from your stressful life. Take precautions to be sure your vacation isn’t tainted by an injury. But, do be aware that if you are injured while on your cruise vacation, you need to talk to an experienced cruise ship accident lawyer immediately upon your return from your trip in order to preserve your rights!

Cruise Ship Accidents: 5 Ways to Protect Your Rights

miami tour

With the recent Carnival Cruise ship accident that injured 61 passengers when the cruise ship violently listed some interesting topics have been brought up that many people are unaware of. For example, did you know that you have a year or less to file your claim? Or, did you know that the fine print on your ticket dictates the location where a suit can be brought? To help you out we have compiled a list of 5 things you need to know to protect your rights when involved in a cruise ship accident.

1.) Know The Location Where You Need to Sue:
Maus says: “Cruise lines designate within their passenger tickets the only location where they can be sued. (Take a look at the tiny print on the back of your ticket). Most of the major cruise lines are based in Miami, Florida and designate Miami, Florida as the location where they must be sued.” This means that if you live in Maine and vacation on a cruise, you may have to litigate in Miami at considerable cost and time to you.
Knowing where you need to take your case is imperative so that your claim won’t be dismissed. Be sure to know the location where you can bring you case. It is not necessarily where the ship left either, so check you ticket before suing.

2.) Know How Long You Have to Bring A Lawsuit:
Maus says: “Cruise lines often insert special provisions into their passenger tickets that shorten the time in which a passenger may file a law suit against the cruise line to one year. (The normal statute of limitations for admiralty and maritime matters is three years; for a typical car accident claim it is four years!)”.
Once again, reading the ticket is key. This will give you the timeframe for which you can bring a suit against the cruise line.

3.) Cruise Ship Accidents Can Happen On Dry Land:
Most people don’t think much about it, but cruise ship accidents can happen at any time during their vacation: when they are boarding or disembarking the ship, when they are walking up or down stairs on the ship or down a hallway, when they are getting on and off a launch or tour bus in an exotic port, or during a ship-sponsored tour or trip into a foreign city.

4.) Document Your Accident:
When the victim of a cruise ship accident be sure to thoroughly document the incident. This includes the following:

Insist a report detailing the incident is prepared by the Cruise Ship personnel
Obtain the names and contact information for any other cruise ship passengers that may be witnesses or have knowledge about the incident.
Obtain the names and identification information for any cruise ship personnel that may be a witness or have knowledge about the incident.
Take photographs of the area where the accident occurred, and any defective conditions that may have contributed to the accident.
Seek medical attention and complain about any part of your body that was injured, no matter how severe or minor.
Request the ship personnel preserve any materials or evidence that is related to the accident or injury. It is best to do this in writing and keep a copy for yourself. Your request should include the preservation of any on board video tape surveillance.

This evidence and information will help you immensely with a case.

5.) Talk to an Accident Injury Lawyer:
Speak to an experienced cruise ship accident injury lawyer. Cruise ship accident and injuries can often involve state, federal or international laws that may be very different from the laws in your area. It is best to speak with a cruise ship accident injury lawyer as soon as possible following the incident to protect your rights.

This article is not meant to turn you away from that long-dreamt-of cruise vacation. Rather, it is meant to make cruise line passengers aware that cruise ship accidents require navigating through confusing and archaic laws. If you are injured while on a cruise, talk to an experienced cruise ship accident lawyer as soon as you get back to dry land so you can protect your rights.

Royal Caribbean Comes to Panama

miami tour

Introduction – Today it was announced that Panama is opening a new cruise ship port and terminal in Colon on the Atlantic side. The port will open in Dec. 2008. At the present time there is a cruise terminal in Colon to receive ships for a day stop only. Ships generally not passing through the canal will stop at Colon disembarking passengers for tours, shopping trips etc. The ships will generally pull in during the morning and leave at dinnertime. Colon is the second largest duty free zone in the world second to Hong Kong. It is simple for one to take a tour from Colon to the Panama Canal.

Royal Caribbean Enchantment of the Seas – Royal Caribbean has announced that it will be deploying one of its modern ships by the name of Enchantment of the Seas. This cruise ship is 80,000 tons and was built in 1997 and refurbished in 1999 and again in 2005. It is not a flag ship of the line, yet still quite a respectable cruise liner. The boat was stretched out when refurbished in 2005 and is now 990 feet long, roughly as long as an aircraft carrier. The ship carries 2446 passengers and has a crew of 760. There are 6 hot tubs, three swimming pools, a rock climbing wall, spa, gym, full beauty salon, jogging track, and of course it has a rock-climbing wall. How can you cruise without a rock-climbing wall? There is a casino, 10 bars, and the ship has 11 decks extending above the water. This is no slouch of a boat. The itinerary of the boat will be Columbia, Aruba and Curacao with 17 such one-week cruises planned during the first season.

Discussion – Okay so now Panama is going to become a cruise port. The major ports in the general region, broadly speaking, are Miami, and Ft. Lauderdale. Many people in Central and South America have difficulty getting visas to go to America. To take a cruise starting or terminating in the USA one must obtain a visa to go to the USA unless they are able to travel to the country without a visa. Most of the countries are not this way with Argentina being the exception.

]]>

The visa process involves waking up early in the morning to go stand online at the USA Embassy waiting to go in for an interview. Numerous documents are required, reasons for the trip, why you are not a risk for overstaying the visa etc. There are fees involved, which are about 5 a person. Many people do not wish to go through this process. Many others are willing to go through the process but are unable to get the visa for various reasons.

Additionally people have been complaining about the treatment they get from USA immigration being unpleasant when they arrive and depart America. This has been hurting the cruise industry in the USA in a big way. Check cruise prices and it is common to see discounts of 50% most of the time from the USA ports of departure. This will give the cruise companies a chance to recover a market they have been missing out on in recent years which is the Central and South American market. It will also give Panama a chance to gain some tourism dollars. People taking cruises frequently come in a day or two before the cruise and stay a day or two after the cruise to see the local attractions.

The word we got was that the other cruise lines would follow suit and begin originating cruises from Panama as well. One could expect to see a bustling cruise port like Miami in the near future is what we were told to expect. We welcome the cruise industry and see it as having a positive effect.

Remember this port is not designed to attract the USA tourist dollar. While some USA tourists will come here the overwhelming majority of the cruisers will be from Central and South America. It is cheaper and easier for the USA resident to take a cruise departing from: Los Angeles, New Orleans, Houston, Tampa, New York, Orlando, Miami, Ft. Lauderdale, or Puerto Rico. This is not going to give the USA some sort of leverage to use on Panama to get them to do what they want like weaken banking laws etc. If the Caymans Islands or the Bahamas did not comply with the USA regarding bank or corporate laws the USA could make like very difficult for anyone cruising to these destinations with lots of searching, long delays clearing customs and immigration etc. Places like the Caymans and Bahamas have heavy cruise and tourism industries that provide many more jobs than the banking industry. If you have ever been to the Caymans not many locals work in the banking sector. The new cruise port in Panama has no applicability to the USA since the passengers will not be subject to USA immigration and customs since the cruise boat will not be originating, terminating or traveling to the USA and the passengers will by and large not be Americans.

We are expecting to see a lot of South and Central American destinations like Mexico, Brazil, Argentina, Uruguay, Chile, Peru, Aruba, Curacao, and Columbia. On longer cruises of 10 days or longer the cruise ships could travel to some of the popular Caribbean destinations like Nassau, Caymans, and Jamaica etc. Panama has very wisely chosen to go after the Central and South American tourism market. Is there going to be a Disney Amusement Park in Panama? Stay tuned.

Ocho Rios is a gorgeous seaside town on the northern coast of Jamaica. The town itself has plenty of opportunities for aquatic activities as well as nightlife specifically catered to tourists.

If you want to get out and explore the surrounding areas while in Ocho Rios, the famous Dunn’s River Falls is a great place to get back to nature. Norwegian Cruise Line’s Eastern Caribbean Adventure

Norwegian Cruises has a great 7-night cruise aboard the Norwegian Pearl. You will set sail from Miami and dock in Samana, St. Thomas, Tortola, and Great Stirrup Cay.

First stop on this trip is a visit to the Dominican Republic village of Samana. This town is most notable as a stepping-off point for whale-watching tours, so keep your eyes open while out on the high sees!

Another highlight of this particular trip will be your stop in Tortola, the largest and most populated of the Virgin Islands. These islands have been inhabited for centuries, but their most famous residents are rumored to be the infamous pirates Blackbeard and Captain Kidd. Maybe you should take some time out of your vacation to do some treasure hunting!

Princess Cruises Southern Caribbean Voyage

Princess Cruises is about to set sail on a thrilling 7-day voyage on the Caribbean Princess. Your captain and crew will safely journey from San Juan, Puerto Rico to Aruba, Bonaire, Grenada, Dominica, and St. Thomas.

If you decide to go out on this cruise, you may want to arrive in San Juan a few days early to make the most out of your time down there. The historic buildings and narrow streets of Old San Juan make this a fantastic neighborhood for just wandering around and seeing the sights. Be sure to take some time out to visit the city’s historic forts like El Morro and the Castle of San Cristobal.

But your San Juan adventure is just the start. The reefs around the island of Bonaire are said to be home to some of the best scuba diving and snorkeling in the world. That is probably why the license plates on the island say “Diver’s Paradise.” There is much to explore on this cruise so get ready for adventure!

Azamara Club Cruises Caribbean Escape

Azamara Club Cruises has a very special trip that lasts a whopping 12 nights aboard the Azamara Journey. Your ship departs from Miami and voyages across the Caribbean to St. John, Marigot, Basseterre, St. Johns, Gustavia, and Virgin Gorda.

Basseterre is the capital of the Federation of Saint Kitts and Nevis, located in the West Indies. The French Colonial architecture is a real treat to behold on this small island town. Though a turbulent center of colonial wars for centuries, Basseterre has turned itself into a financial and industrial center, as well as a great place for tourists to explore.

A highlight on the island of Virgin Gorda is the strange geologic formation that is called “The Baths.” Here the beach shows remnants of the volcanic origins of the island. Granite boulders are scattered across the beach and many of them form little grottoes that face the wide ocean. Scenery and adventure abound on this extended tour of the Caribbean.

As you can plainly see, the glories of the Caribbean are just waiting to be explored. Don’t waste your precious time planning every detail of your vacation out. Kick back and let the trusted captain of your cruise ship take you on a relaxing journey through the historic and beautiful Caribbean Sea.

Cruise Vacations: Alluring Destinations Around the World

miami tour

There has never been a better time to hit the high seas for a cruise vacation. An estimated 18.4 million passengers will be cruising the world’s waters in 2010 in search of a remarkable vacation.

According to Cruise Market Watch, the worldwide cruise capacity is up almost 7 percent in 2010, as cruise lines add new ships to boost their lines. And with the additional space, some cruise lines are offering value pricing so the new space and the existing spaces are booked.

There are plenty of short-range cruises available for a quick getaway:

A three-night cruise to the Bahamas for just 9. You’ll see Miami, Fla., Nassau and Norwegian Private Island.

Or maybe you would like a five-night cruise to the Western Caribbean, starting in Miami and traveling to Ocho Rios and the Grand Cayman – all for 9 per adult passenger.

Or for 9 per adult passenger, go the other direction toward the Eastern Caribbean for a seven-night cruise to Miami, Samana, St. Thomas, Tortola and Great Stirrup Cay.

Or, if you want to start on the West Coast, consider a seven-day cruise from Los Angeles, Calif., to Mexico. For 9 per adult passenger, you can enjoy stops in Puerto Vallarta, Mazatlan, Cabo San Lucas and then back to Los Angeles.

These cruises offer just a taste of the quick-trips available from U.S. ports of call. There are plenty of other ventures on both sides of the coast to experience. But with cruising so hot this year, this may be the time to try a trip that’s a bit more alluring – someplace off the Caribbean track.

How about a seven-night cruise to Australia and New Zealand for just 9 per adult passenger. You start in Sydney, Australia, and will continue on to Noumea and Isle of Pines, both islands making up New Caledonia.

Starting for around ,000 per person, you can take a 12-day cruise to Latin America and see sites you’ve only heard about in an atlas. The trip starts in Buenos Aires, Argentina, and includes Montevideo, Urugyay; Falkland Islands; a sail by Cape Horn, a stop in Ushuaia, Argentina; a cruising tour of Romanche & Alemania glaciers and the Cockburn & Beagle Channels; a stop in Punta Arenas; passage through the Strait of Magellan; a cruise through the Amalia Glacier Canal and passage through the Darwin Channel Chilean Fjords. The trip concludes in Santiago, Chile.

Want to go the Far East? How about a five-night cruise of Asia, starting at ,045 a person. You will start in Hong Kong, China; travel on to Sanya, China; and then head onto Hue and Hanoi, Vietnam; before ending back up in Hong Kong.

Got dreams of seeing the South Pacific? Consider the ,595 10-day South Pacific cruise. It will take you to places most people only read about: Tahiti, Rangiroa and Bora Bora – all in French Polynesian.

Ever dreamed of seeing the Grecian Isles? What better way than on a seven-night European-Mediterranean cruise for just 9 a person. The adventure starts in Venice and onto Bari, Italy. From there, the ship sails on to the Greek isles of Katakolon, Santorini, Mykonos and Rhodes. Last stop is Dubrovnik, a hugely popular tourist city on the Adriatic Sea.

Want to get off the high seas? Consider a 9 per person, four-day cruise of the Avalon Waterways. You will start your river cruise in Vienna and follow on to Melk-Dürnstein in Austria; Bratislava, the capital of Slovakia; and finish the tour in Budapest, Hungary.

For a trip you’ll never forget, spend 10 days exploring Egypt and the treasures of the Nile. Start by spending three days in Cairo, exploring the Kingdom of the Pharaohs, King Tutankhamen’s treasures, the Sphinx and the Great Pyramids of Giza. From there, you will fly to Aswan where you will embark on a four-night cruise of the Nile River where you can experience temples dedicated to crocodiles and falcon gods and the Valley of the Kings and Valley of the Queens where 62 royal tombs have been unearthed, leaving many untouched. Conclude your adventure with a visit to Karnak, ancient Egypt’s greatest city. You will wind up back in Cairo in time to take in an evening of modern entertainment or rest up for the flight home the next day. The cost for all this is ,211 per passenger.

Now that you have an idea of the tame and the more adventurous offerings, you need to take these into consideration when selecting your cruise:

Is it an all-adult trip, or will you have to worry about little children? Older children will enjoy some of the historical sites more than their younger counterparts.

Does vacation time allow for a 12-day cruise? Or might a four-night quick getaway suffice for this year’s getaway?

Is one of these trips on you bucket list? If so, start there. The others will have to wait.

Some of these companies which help in finding apartments also offer virtual tours of the apartments for their customers.

Depending on ones budget and lifestyle one can check for one, two or three bedroom apartments. One must make sure to clear all their doubts regarding the rent and the apartment before moving into the apartment. Also one should discuss in advance about the mode of payment. Rents can be paid monthly, quarterly, half yearly or even annually. Some apartments follow the yearly lease system; the lease can be renewed if the tenant chooses to live in the same place.

It is always recommended that the tenant first checks for the average apartment rent and then checks for the various apartments. This will give the person renting the apartment an idea about the costs involved. Also one should keep in mind to do check the apartment thoroughly for any repairs before moving in to the apartment.

Some landlord’s insist on having tenants with a clear record of timely payments and hence people with a history of broken lease and a bad credit history may find it difficult to find an apartment in a good and a safe neighbourhood. One may find apartments for cheaper prices in not so good neighbourhoods too.

HISTORY

After more than a decade of operation, Richard Petty Driving Experience has become the premiere motorsports entertainment company in the industry.

The program was based on a “battle of the bands” type format, with up and coming drivers being graded on their ability to hit marks on the track while following an instructor. The top 25 drivers were invited to return in a qualifying shootout at the Thunderdome, the Australian worldclass superspeedway. The program was a remarkable success, and Graham knew he had come across something great.

1990 – Graham then decided to tap into the tremendous interest in stock car racing in the United States

1994 – The company completed its transformation and became Richard Petty Driving Experience (RPDE). With a handful of cars, a small shop and an office in Concord, North Carolina, RPDE opened its first permanent location at what was then the Charlotte Motor Speedway.

1996 – Las Vegas Motor Speedway became the second permanent facility for RPDE and the first driving experience of its kind west of the Mississippi.

1999 – The overwhelming success of RPDE at this point led to the addition of Atlanta Motor Speedway as its fourth permanent location, and the addition of these new tracks on the schedule: Homestead-Miami Speedway, Richmond International Raceway, The Milwaukee Mile, Gateway International Raceway, California Speedway and Bristol Motor Speedway.

2001 – The addition of tracks continues to grow with dates at Kansas Speedway, Chicagoland Speedway, Michigan International Speedway and Talladega Superspeedway inserted into the calendar.

2004 – Added a permanent location at Chicagoland Speedway.

2005 – With safety as our primary concern, RPDE implements the use of HANS device for both drivers and riders into the programs. A new High Performance Karting program was also added.

2006 – RPDE debuts at the Martinsville Speedway and as the first event at the new Iowa Speedway in Newton, IA.

Richard Petty Driving Experience looks forward to continuing its success as the premier motorsports entertainment experience in the industry.
